Re: Stakeholder Comments on Strawdog Draft – Revised MSA Investigation Procedures

On February 6, 2008 the MSA notified stakeholders that it had commenced a Stakeholder Consultation Process in relation to revised MSA Investigation Procedures being contemplated by the MSA.  At that time the MSA published a ‘Strawdog’ draft upon which interested parties were invited to provide comment.

Comments were received from three market participants during the comment period set out in the related Project Schedule.  In accordance with its Stakeholder Consultation Process, the MSA is publishing the comments received on the Strawdog draft.  Those comments can be found through the following link(s):



The MSA is considering the comments received and will formally respond to the comments when it publishes the revised Draft MSA Investigation Procedures.  That step is anticipated to occur on March 5, 2008.

The MSA would also note that a request for an extension to the comment period deadline was received on the afternoon of February 20, 2008 (the last day of the two week comment period) from one market participant.  As set out in the generic Stakeholder Consultation Process, in order to be considered such a request must be received at least two days prior to the deadline and must include reasons for the request.  In this case the request for extension did neither, and so was denied.  However, the market participant was reminded that a further opportunity for comment will occur when the MSA publishes its revised Draft MSA Investigation Procedures.

The Project Schedule for the Stakeholder Consultation Process will be set out at each stage, and will be updated as applicable.  For clarity, the process is currently in the ‘Develop’ stage (see attached Project Schedule).
