NOTICE TO MARKET PARTICIPANTS

Re:  AUC Decision 2010-143/Consent Order/MSA ENMAX

On July 21, 2009 the Market Surveillance Administrator (MSA) filed an Application with the Alberta Utilities Commission (AUC) seeking an order imposing an administrative penalty on ENMAX Corporation, ENMAX Energy Corporation and ENMAX Energy Marketing Inc. (collectively referred to as ENMAX) in relation to an investigation carried out by the MSA.  On November 5, 2009, in accordance with the process established by the AUC, ENMAX filed its response to the Application.

On January 15, 2010 the MSA and ENMAX (the Parties) filed with the AUC a request for a Consent Order based upon a Settlement Agreement between the Parties.  Consistent with that Settlement Agreement, on March 31, 2010 the AUC issued Decision 2010-143, ordering ENMAX to pay an administrative penalty of $25,000 and terminating other parts of the original Application.  The matters at issue in the Application are thus concluded.
